These conditions refer exclusively to non-commercial natural persons.
The parties agree that their relationships will be exclusively regulated by this contract.

If a condition were to be lacking, it would be considered regulated by the uses and customs in force in the distance selling sector according to the rules of the professional code of the Distance Selling Association.

By becoming a user of HD ALICANTE, undertakes to respect these conditions of use. If you do not accept these general conditions of use, you should not register HD ALICANTE as a user. The inscription HD ALICANTE as a user implies the total and complete acceptance of these conditions by the client.



These CGC (General Contract Conditions) together with the request for specific products made by the user imply the formalization of the sale contract between HD ALICANTE and the user who claims:

Orders

Users / clients have the possibility of placing their orders online: through www.h-dalicante.es.

To place your order, the user / client must provide certain types of information:

- Providing your user / client number, in case you are already a user / client, which is strictly personal.


- Completely filling in the blanks of the online order without spaces and without points.

In case of being a new user / client, the user / client number will be transmitted by the services of HD ALICANTE after the first order.

The fact for the user / client to place the order is equivalent to the full and entire acceptance of the prices, the description of the products for sale and the general conditions of sale, which will be the only ones applicable to the contract thus concluded.

The internet portal of HD ALICANTE allows the user / customer to check the content of their order, and where appropriate, modify and validate it definitively.
In this way, the order will only be saved permanently when the summary screen of the order is validated for the last time. PRICE, PAYMENT AND BILLING


In the prices of the motorcycles are excluded registration, transport and second place. The prices of the Products are indicated in euros (VAT included), excluding shipping costs. Shipping costs are borne by Borjamotor SA and are free for the user / customer.



Any change in the VAT rate will be automatically applied to the price of the Products.


Payment and billing.


You can choose between the following forms of payment:

The amount of the purchases will be charged to the bank account of the user / client once the confirmation of authorization is received from the bank payment centers.

Exceptional situations.

ORDER CONFIRMATION

Order placed


After the final recording of the order placed, A confirmation email will be sent to you. By keeping this email and / or printing it, you will have a proof of your order that HD ALICANTE recommends you save.
Attention: this email confirms that your order has been considered by HD ALICANTE and not that the ordered Product is available. 99% of the time the product will be available, it will be a very exceptional case that it is not.

We always work with merchandise in stock either in the store or at the factory, except in the case of motorcycle accessories, but we also review our merchandise before sending it and if we detect any defect or damage, no matter how small, we will not send it to you. This is 1% of the times in which this non-availability of the product occurs.

Unavailability of a product.

Delivery


The delivery of orders within Spain (except for force majeure or holidays) will be made within the estimated period of 72 hours from the product's departure from our warehouse. Orders placed after 14:12 pm will be processed the next day. Saturdays, Sundays or holidays are not counted. For deliveries in the Balearic Islands, the delivery time will be 17-XNUMX days.

Deliveries are made Between 2 and 12 business days from the order date according to stock availability. In case of taking longer, the client will always be notified in advance. Most orders are delivered within 72 hours. For orders outside the peninsula (Balearic Islands) this period is extended to 17 days.

Faced with any lack of stock or modification of the order, we will contact the buyer before serving the order, to look for a possible product change or wait for the replacement by the supplier. In the latter case, the times are subject to the response time of the provider.

Each delivery is considered made from the moment in which the transport company makes the product available to the user or person authorized by the latter, which is materialized through the control system used by the transport company.

Precautions to be taken into account at the time of delivery


It is the responsibility of the recipient to check the shipments upon arrival, express observations and submit all the claims that he deems appropriate, he may even reject the package, if the latter is likely to have been opened or if it shows clear signs of deterioration. The purchase of articles in this section is firm and without a return guarantee. The delivery time will depend on the factory stock, approximately 3-4 weeks. RETURN


If you are not satisfied with the item (s) received, and as long as the product is not used and is kept in its original packaging, as received, you have a period of 1 month to return it, counting from the date delivery of the order (according to art. 44 of Law 7/1996, of January 15, Retail Trade Regulation modified by Law 47/2002, of December 19) .The buyer will bear the costs of the return and first shipping (for the peninsula € 6,51 and for the Balearic Islands € 15) or only the first shipment in the event that the client decides to send it directly to the dealer. Once received in our warehouse and checked the status of the item (s), we will proceed to replace it with another or to refund the amount paid by bank transfer or credit to the bank card with which the payment was made. The refund of this amount will be made within a maximum of 30 days from the receipt of the order in our warehouse.

If the item is not received in its original packaging, it will suffer a depreciation of its value.

In the case of defective products or erroneous shipments, all shipping costs will be at our expense.


Always indicate on the delivery note of the carrier to make the delivery if you observe that the order is in poor condition and check the merchandise in their presence, also indicating the defects you find on the delivery note. Exceptional situations


Any item can be exchanged or refunded except for products that bear a contrary mention.
For hygiene reasons, underwear and swimwear cannot be returned.
The articles in our accessories section are firm and without a return guarantee.


Return procedure.


In accordance with the above, HD ALICANTE establishes the following return procedure detailed below for users who wish to return the products they purchased.

You have a period of 15 business days to communicate by email your intention to return your purchase.

In the subject of the message you must write the word "Return" followed by your order number.

In the body of the message you must specify the references of the products you want to return as well as the reason for the return.

The product must be in perfect condition and with its original packaging and labeling. The return may not take place in any case if the products supplied were clearly used.

The return number must be clearly written on the outside where the shipping address is indicated.

A copy of the purchase invoice must be included in the package, where the returned products and the reason for the return are marked.


Return conditions.


Returns that do not comply with the stated conditions will not be accepted.

Except in the event that the delivered product is defective or incorrect, the expenses and risks related to the return will be borne by the user / client, who must send them safely and with the necessary guarantees so that the returned merchandise arrives in perfect condition. conservation.

When the delivered product is defective or incorrect, HD ALICANTE will be responsible for collecting the product at the address indicated by the user / customer.

HD ALICANTE does not accept returns sent postage due or cash on delivery.

The reimbursement in the customer's account as a result of the return will be made in the shortest possible time from the receipt of the goods by HD ALICANTE. The return of the products will give rise to a refund equal to the purchase price of the returned product / s. The refund does not include any costs of delivery.

Guarantee and after-sales service.

In any case, the customer will enjoy the guarantee against hidden defects: in this way, if the Product has a manufacturing defect that prevents its correct use, the customer may contact the after-sales service of the HD ALICANTE:

All Products marketed by HD ALICANTE have a conventional guarantee against hidden defects provided by the suppliers of HD ALICANTE.

In order to apply this guarantee, the customer must send, at his / her own expense, the Product to the HD ALICANTE, without forgetting to include the invoice. In this case, HD ALICANTE undertakes to send, at its own expense, a Product free of hidden defects to the client, in exchange for the previous one (except when the reservation is exhausted).

In the event that the reservation is exhausted and that the supplier cannot exchange the Product for another, the customer will be proposed to choose between a similar Product or a refund of the initial Product.
